General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from QMG Deutsche Nahrungsergänzungsmittel Invest & Northern Fish Oil GmbH (hereinafter referred to as QMG GmbH) to consumers.
A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed professional activity.

2. Contracting Parties

The purchase agreement is concluded with QMG GmbH, Owner: Markus Geisbüsch, Postfach 1, 65812 Bad Soden am Taunus, Commercial Register: Amtsgericht Königstein im Taunus HRB 12200.

3. Conclusion of Contract

3.1. The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.
3.2. By clicking the button [Buy/Order with obligation to pay], you place a
binding order for the goods listed on the order page. Your
purchase contract is concluded.

4. Right of Withdrawal

4.1. If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with statutory provisions.
4.2. If you, as a consumer, exercise your right of withdrawal in accordance with clause 4.1, you shall bear the regular costs of returning the goods.
4.3. Otherwise, the provisions detailed below apply to the right of withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform QMG Deutsche Nahrungsergänzungsmittel Invest & Northern Fish Oil GmbH, Postfach 1, 65812 Bad Soden am Taunus, +491726227622, webmaster@northernfishoil.com by means of a clear statement (e.g., a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
You can also exercise your right of withdrawal online at www.northernfishoil.com. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g., by e-mail) with information on the content of the withdrawal declaration as well as the date and time of its receipt. You can also fill out and submit the model withdrawal form or another clear declaration electronically on our website. If you make use of this option, we will send you a confirmation of receipt of such a withdrawal immediately (e.g., by e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back or hand over the goods to us or to DHL Regioparkring 30, 41199 Mönchengladbach to a person authorised to receive the goods without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

4.4. QMG GmbH provides information on the model withdrawal form in accordance with statutory regulations as follows:

5. Prices and Shipping Costs

5.1. The prices listed on the product pages include the statutory value-added tax and other price components.
5.2. In addition to the stated prices, we charge a flat rate of five euros per order for delivery within Germany. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and on the order page.
5.3. For payment by cash on delivery, an additional fee of five euros will be charged by the delivery person on site. No further taxes or costs will be incurred.

6. Delivery

6.1. Delivery is only available within Germany via DHL.
6.2. The delivery time is up to 3 days. We will indicate any differing delivery times on the respective product page.

7. Payment

7.1. Payment can be made either by bank transfer in advance or cash on delivery.
7.2. If you choose the payment method "bank transfer in advance," we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Warranty for Material Defects

9.1. QMG GmbH is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code.
9.2. An additional guarantee exists for goods supplied by QMG GmbH only if this has been explicitly granted in the order confirmation for the respective item.

10. Dispute Resolution

We are willing to participate in dispute resolution proceedings before a consumer arbitration board for disputes with consumers, or are obliged to do so according to GmbH's legal norm or contractual agreement. The competent consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.universalschlichtungsstelle.de. We will participate in a dispute resolution procedure before this body for the aforementioned disputes.
Alternatively: We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
